Worldwide, sport participation rates among women lag those of their male counterparts. This Comment analyzes the differing approaches taken by Canada and Spain to addressing gender inequality in sport participation in their respective countries. This Comment then evaluates the strengths and weaknesses of Canada and Spain’s approaches. By comparing both approaches, this Comment concludes that Spain’s approach is better suited to addressing gender inequality in sport participation. Subsequently, this Comment proposes a framework, styled after Spain’s approach, for Canada to adopt to promote gender equality in sport participation. This Comment considers the constitutionality of its proposed framework and, deeming it legally permissible in Canada, concludes with a recommendation for Canada to adopt it.
