This Paper provides a brief overview of monopoly law and current enforcement policy under section 2 of the Sherman Act. It recommends more vigorous enforcement of section 2, including increasing the number of investigations of dominant firms that engage in abusive behavior, adopting a more balanced and less monopolist-friendly approach in amicus briefs, and recognizing that intellectual-property rights do not confer antitrust immunity.
