There are more than ninety federal statutes authorizing financial aid to states, cities, schools, and various institutions under the numerous programs administered by the Secretary of Health, Education and Welfare. This cornucopia of government spending and the ever increasing involvement of the federal government in American education raise an important question of current interest. May the United States Commissioner of Education, acting under the color of title VI of the Civil Rights Act of 1964, withhold federal funds from colleges and universities at which there are fraternities or sororities with racially discriminatory admission practices?
